Banks and Merchants Reload for Fee Battle

Banks and credit unions are using a recent
debit-card scam at Michaels Stores Inc. as fresh ammunition in their
fight against a federal proposal to reduce the amount they can charge
merchants for processing such payments.

The new attack is aimed at part of the Dodd-Frank financial-overhaul
law enacted last year that limits the fees banks can charge retailers
each time a consumer swipes a debit card. The measure has pitted banks
against merchants and has been one of the most contested provisions of
the financial overhaul law on Capitol Hill.

The
debit-fee measure requires the Federal Reserve to write a rule
restricting what are called swipe fees. The central bank issued a draft
proposal in December, capping the fees at 12 cents a transaction for
large banks, down from the current average of 44 cents.

Banks have assailed the proposal, in part because they say it doesn’t
take into account the cost of losses that result from a bank data theft
or breach. Customers aren’t liable for unauthorized debit
transactions; those costs are typically absorbed by the bank that issued
the plastic. In a survey, the Fed estimated that industry-wide fraud
losses to all parties involved in a debit transaction in 2009 were about
$1.4 billion, while roughly $15.7 billion in debit swipe-fee revenue
was collected.

Now, banks have a handy, real-world example to use in their argument.
Industry lobbyists said they have raised the Michaels breach with
several lawmakers in recent meetings as they push for legislation
delaying the debit-fee rule. “It has gotten their attention,” said one
of the lobbyists, Camden Fine, head of the Independent Community Bankers
of America.

Michaels, an Irving, Texas, chain of arts-and-crafts stores, this
month said thieves had collected customer debit-card data by altering
the devices that they use to swipe their cards. The thieves stole
personal-identification numbers, created duplicate cards and withdrew
cash from customer bank accounts.

Though Michaels said fewer than 100 customers have reported
fraudulent transactions, the company said it found that equipment had
been compromised at 80 stores in 20 states. As a result, banks have been
reissuing cards and taking calls from customers worried that their
accounts could be at risk.

The situation at Michaels just “illustrates the point that customers
who have their account information breached can get that money back from
the banks because of the way the debit-card product works today,” said
one executive at a big bank.

Fraud costs won’t go away when the Fed caps
swipe fees, banks say, so they will have to find other ways to address
those costs, such as raising fees on consumers and eliminating rewards
programs. Banks have said they may protect themselves from fraud losses
by capping debit-card transactions at $50 or $100. They haven’t said
they would stop reimbursing consumers.

The National Association of Federal
Credit Unions sent a letter Monday to Senate leaders urging them to
support a bill that would delay the start of the proposed debit-fee
rule, which is scheduled to take effect in July. The letter cited
comments from John Menzer, chief executive of Michaels, who encouraged
customers to consult their banks if they were concerned about
unauthorized charges.

“This is a prime example of the role that debit interchange plays in
ensuring the payment system operates smoothly and efficiently for
consumers and financial institutions,” wrote Dan Berger, executive vice
president at the credit-union trade group.

“These issues aren’t being dealt with by Michaels. They are being
dealt with by the card issuers,” Mr. Berger added in an interview.

The retail industry is pushing back.
Retail officials say in many cases banks make merchants cover the cost
of fraud incidents. Retailers say they also have invested billions of
dollars helping to plug security holes while the banks refuse to take a
step that, according to retailers, would make the system far safer:
Issuing consumers cards embedded with computer chips, which retailers
claim are less vulnerable to fraud than debit cards that require a
signature.

“Their argument that they need even more swipe fees to protect the
system they’re not already protecting is really just a load of bull,”
said Mallory Duncan, senior vice president and general counsel for the
National Retail Federation, a trade group.

The effort to delay the fee rule faces
the biggest challenge in the Senate, where Sen. Richard Durbin (D.,
Ill.)—author of the provision—is the No. 2 Democrat and any measure must
get 60 votes to overcome a potential filibuster. Mr. Durbin, backed by
retailers, is fiercely resisting efforts to delay the debit-fee rule. He
has repeatedly blasted regulators for raising what he calls
“speculative” concerns that the debit-fee measure will hurt small banks
and credit unions, which are technically exempt from the fee cap.

Lobbyists say a delay-bill written by Sen. Jon Tester (D., Mont.) is
close to having enough votes, but that he may need to scale it down from
a two-year delay to a one-year delay to get it over the 60-vote
threshold.

Specific Issue Testing

When
a specific and identifiable incident occurs (theft, sabotage, arson, homicide,
assault, fraud, sexual contact with a minor, marital infidelity, etc.)
the polygraph technique is the most effective means available to determine
the credibility of a person’s statements. Currently polygraph test
results are admissible in over 20 states, and as one court has said, “the
greater weight of authority indicates that it [polygraph] can be a helpful
scientific tool”.

A specific issue polygraph
examination consists of the following steps.

1. A personal conference
or telephone discussion during which the polygraph
examiner obtains a complete history of the case background information;

2. A pretest interview
with the subject which will generally last 45 to 60 minutes, during
which the examiner discusses the issue under investigation, thoroughly
reviews all of the test questions that will be asked during the examination,
and assesses the individual’s emotional and physiological suitability
to take the test;

3. A series of 4
to 6 tests, during which the subject’s physiological responses
are recorded as they answer a set of pre-established questions concerning
the issue under investigation; and,

4. A review and
interpretation of the polygraph charts, from which the examiner will
reach one of three conclusions – that the subject is telling the
truth; that the subject is not telling the truth; or, that the results
are inconclusive.


Upon completion of the examination, a verbal report will be given to the
client, followed by a written report which will provide a synopsis of
the case information available to the examiner at the time of the testing,
a list of the relevant test questions, the subject’s answers, and
the examiner’s opinion as to the subject’s truthfulness or
deception.

have 20+ years experience and are graduates of American Polygraph Association
accredited schools which required a baccalaureate degree and successful
completion of an approved, one year, internship program.

Employee Polygraph
Protection Act (EPPA) – Polygraph Testing for theft and losses in the
business workplace.

Section
801.12 of the Federal Registrar, Vol 56, No. 42, page 9067, Final Rules
and Regulations, March 4, 1991

An employer may request
an employee to submit to a polygraph
test,
only if-

(1) The test is
administered in connection with an “Ongoing investigation”
of an economic loss or injury to the employers business, such as theft,…
or an act of industrial espionage or sabotage.

(2) The employee
had “access” to the property.

(3) The employer
has “reasonable suspicion” that the employee was involved
in the incident.

(4) The employer
provides the examinee with a statement, which fully explains with particularity,
the specific incident being investigated and the basis for testing particular
employees and which contains

(i) an identification
with particularity the specific economic loss or injury.

(ii) a description
of the employee’s access.

(iii) a description
in detail of the basis of the employer’s reasonable suspicion.

(iv) the signature
of a person authorized to legally bind the employer.

(5) The employer
retains a copy of the statement and proof of service for at least three
years.

In addition…

(c)(1)(i) The terms
“economic loss or injury to the employers business” include
both direct and indirect economic loss or injury.

(iv) Indirect loss
or injury also includes theft or injury to property of another for which
the employer exercises fiduciary, managerial or security responsibility.

(2) Economic losses
or injuries which are the result of unintentional or lawful conduct
would not serve as a basis for the administration of a polygraph test.

The examinee
must be:

(i) provided with
a written notice as to when and where the examination will take place
and that the examinee has the right to consult with counsel or an employee
representative before each phase of the test. Such notice shall be received
by the examinee at least 48 hours, excluding weekend days, before the
examination. The written notice must set forth the time and date of
receipt by the employee…and be verified by his signature.

This examinee has
other specified rights regarding the polygraph which are the responsibility
of the examiner. Section 801.26 specifies qualifications and requirements
for examiners.

I am trying to  locate information on soft ware that is used to flter and detect any spoof cards and computer programs used to alter a person’s voice over an internet phone line or skype service inorder to  commit fraud and commit crimes.  I want to civily /criminally prosecute these individuals to the full extent of the law and need definitive evidence of their crimes.  Can you tell me of a program that will either analize a person’s voice to allow a definitive identification of the criminal or even the program being  used to alter their idenity?

The process of moving within an audio file or tape to locate a particular section. The term originally comes from the days of reel-to-reel players, when rocking a reel would give the impression of scrubbing tape across the head. Many audio scrub tools today allow the user to drag a cursor across the wave form to audition different sections of an audio file.

Skype Voice Changer




If you always wanted to sound like someone else when making calls in Skype you might find the Skype Voice Changer application handy. The software provides the means to change the voice in Skype but can also alter the voices in mp3 or wav files that get loaded directly into the software. The current release is an experimental release that makes use of filters to alter the voice in Skype in realtime. All that needs to be done is to select one or multiple filters from the list of available ones and press the Connect To Skype button in the top bar.


The program provides access to a dozen filters ranging from Delay and Tremolo to Chorus and 3 Band EQ. While it is not currently able to change the voice in Skype to that of Darth Vader, or any other famous living, dead or fictional celebrity in this regard. Each filter can be configured separately by using the sliders that appear after the selection. The amount and function of the sliders depend on the selected filters. They usually range between 3 and 6 different sliders to change the frequency, length or delay.

Multiple filters can be combined with each other to use all their effects for the voice changing process. Skype Voice Changer is currently available for computer systems running Microsoft Windows. A version of the Microsoft .net Framework seems to be required to run the software although no details are given on the program’s homepage.
