Florida Bar files complaint against David J. Stern over MERS case

The Florida Bar filed a complaint against foreclosure attorney David J. Stern Friday afternoon for allegedly violating the bar’s rules by failing to produce documents as ordered by the court in February.


One of the stated rules Stern allegedly broke: “A lawyer shall not knowingly disobey an obligation under the rules of a tribunal except for an open refusal based on an assertion that no valid obligation exists,” the filing states.


The complaint is asking for an investigation to find out why Stern did not file the documents, and is asking for disciplinary action. The document does not suggest what that action should be if Stern is found culpable.


At the beginning of the year, the Law Offices of David J. Stern represented SunTrust Bank in a lawsuit against Mortgage Electronic Registration Systems, according to the complaint. The Florida district court issued Stern’s firm an “order to show cause” on Feb. 16, which asked him to prove why sanctions should not be entered against him after he neglected to file certain documents “in a timely manner.” Stern allegedly ignored this order, the complaint said.


“Respondent failed to produce the documents and has otherwise failed to respond,” the complaint said.


On March 14, the issue was referred to the Florida Bar to figure out why Stern did not abide by the order. Stern attained a mountain of litigation against him and his firm during that period, as investigations into the robo-signing scandal were well underway.


Stern lost Freddie Mac‘s business in November 2010 over foreclosure documentation issues, and lost Fannie Mae‘s shortly thereafter. On February 25, the Florida Attorney General launched an investigation into several real estate law firms across the state, including Stern’s. In March, the Plantation, Fla.-based company ceased foreclosure work and stopped trading on the Nasdaq.


Stern’s attorney Jeff Tew told The Palm Beach Post his client was fired from SunTrust in mid-December 2010, before the Feb. 16 order was issued. Tew also said it was possible Stern missed the notice among 10,000 pieces of incoming mail everyday.

So i just  went out and collected my mail this evening… a really beautiful night….  cool and peaceful and really  nice… i got a letter from judge murphy with his order to vacate the sale of my condo but what was disturbing was a letter that was written by “my mother”….  I thought that she was mentioning the fact that i believed tha t patric webber was still incharge as a guardian  and his duties were to assist in financial payments……    i thought the letter was requesting an injunction to stop the saleand transfer of title….  i assumed that the envelopes  addressed in care of patrick  webber….. and even the paperwork filed atteh court house also incare of patric webber…. would  sufice in an irreglarity… and be subject to a dismissal…     but i guessi hve to waittoa see what the lawyers have to sayabout all of this… 

whata was /is disturbing ths evening when i called to tell my motehr of the letter i received…  once again i have a mother on the phone  who sticks up for karn kahel…  teh bulling trespassing  whore who  went to ohio state…. Ugg… infact i had a person onteh phone who wants me to have a horrid mental iillness….  and  wants me to ( and I quote : “Keep Karen Out of it…. ” )   a boy/mother who goes to any lengths to protect a girl who tresspassed… who bullied me ntoonly to tears but to throwing up… because i wasa so upset by waht she said to me… a horrid person… who is not my freind.. who willnever be a freind.. and who i pray every day for herto be prosecuted for ruining  my ife and  put in jail for the rest of her life…   a person i wihd i had never met.. and who gives people fromohio a bad name….

i just got two phone calls without caller ids.. froma bully who has decide that they are allowed to say tha i am bipolar… this is teh latest of teh affllictions i am suppsoed to suffer from.. when i lost 30 lbs after beign bulled by gerard… then i was supposed to be annorexic.. wheni cried because someone bullied me then i was suppsed to be manic depressive… when i had carla as my roomate and her brother  had soeme problem that then i supposedly had…  then someidiot had a drug problem..or an alchol problem… all of these problems i nver had… adn tonight.. the bully.. without a caller id… who  sticks up for teh whore fromoho state.. opps..i mean the bully from ohio state… it was reminiscent foteh bullies i had totalk to when  icalled la playa…  its defiantely a boy… and defiantely a horrible and destructive person who wants tocasue me harm. and whoknws anidiot whowants my condo? or whojsut gets a kick out of seeinga girl cry….. ive had enough of those horrible  sadistic  people wh  got a kick out of buling me… i even changed my phen number so many tie strying to never have to speak to them again…  

this evening..after the two calls with out caller id… i am shaking..  ready to throw up… and  completely upset…. they should be put in jail….. i dotn care if they are  kids… or boys… or men.. whoever tehy are.. they wer quoting  actors who were bipolar….as if i shudl want to have a problem… which i do not… and never have…  i jsut had some as hole decide that it was alright to runi my life…HUMMMM maybe the fat disgusting pig gerard ahler.. inhis scummy sweat suit… adn untied high top sneakers.. frombrooklyn new york who said he was a memebe of the mafia…

I am calling the poice to let them know…. when they were able  monitor the phone.. i nver had any bully calls like this…  theswe made my hair stand on end … on the  back of your neck.. and on my arms… like speaking to pure evil…  it makes you feel creepy all over….. 

it was not my mom because wheni clled her number… she was nicer… and  said she was getting ready to go to bed… ( a bit early at 9:23pm so it maynot be her… but it was nott he same people who called at :

 Both bully calls…  both not from my mother…   both caller should l be put in jail…..


so i called the police station spoke wtiha very nice deputy Dascani concerning the bully/ anamanious calls….

she suggested to  dial *57 which shoudl get the number of teh last call…. even  when there is no caller id showing …   She says that a police car can come out  after 3 times of harassing calls…..

 she is having a police man call me to advise me as to what i should  do….and how we can catch the bullies…. I havent had calls like this in a while….  i know i dont want them to start again…. and if i have to have the pollice monitor all mycalls… that would be great….  i am not going  through all this all over again… i am not a punching bag for someone to harm..    

I also received a few postcards… noletters from ohio that had bully informatin.. damagin notes.. but a note that said i was “supposed to go with it… whatever was to happen to me and  my home… a bit simialr to the advice i was given over the phone  ….  that i shoudl “be quiet” … and” take whatever anyone wanted to do to me”… or to “say to me” …   slo i am supposed to “get over it”……..whatever happens……that  somehow it was alright for people to  take things from me.. to lie to me to bully me… the quote is… accept things as they are happening…  Hell NO!… that note  is not from anyone in my family… let alone mymother who always wanted mto have a home of my own  in my name …. and who never…. i mean never jstu sat aroudn whiel someoen was tryingto commit an injustice…. remember this si a woman who wasa able to start adn make a successful business in a country where she had no rights… where  she coudln’t drive out of the gate… who  raised three girls to be stong independent women  who followed laws…
(infact one daughter became a lawyer.!… )     she never sat around  and allowed people  to steal from her…or her family…  

 I just  got a call from corporal demayo….from the police or sheriff department….  his suggestions… 9 incase this ever happens  again…     I am to dial  * 87 to get the callers telephone number…..
to just hang up…. dotn take any abuse… and get the  number… if they call a total of three times….. then they can  get  a code that can be taken to the  phone company …. and from there criminal charges can be brought against the  criminal… 

another suggestion he had was to doa * 82 which will block  the call…. he suggested that i find out from magic jack  how to catch the criminal….

Fri August 5th 2011 @7:48pm ( very odd incident with my white d/g dress)

So today i went to iron my white dress i had washed it  by hand  and let hang dry…. the same dress i wore for my b-day dinner… i bought  the  dress years ago… classic shell dress. I bought it at saks 5th ave, It  is a white dolce gabana dress that cost between $500.00-$1000.00  so i take very  special care of it…. ( actually i had almost all nice classic clothes…( before 2003…. i thnkof the time meeting scum as the end of the time i had a great life…. wtih great possessions and was protected,,, and loved…. and well had a great life….)    My clothes adn possessions….  they were quality  and usually lasted forever.. my  mom taught me to shop that  way… infact i even have some of her old dresses… (now considered vintage)… but in great condition…  anyway… i know the dressI purchased  was understated… the only way i knew it was a dolce gabanna was the lineing that had the words dolce/ gabanna all over the  lining… and the zipper…. and of course the tag…. but i have found that  some of my other  clothes have the l tags… but the items  were altered without my consent or knowledge…. 

anyway.. as of today… while i was ironing… i noticed that the hem was curling up….  and the lining had no  dolce gabanna name printed all over  it…..  now i know i never got back my cashmire kaki sweater that  was a part of a sweater set i got for christmas…. and of cours the jewlery i had been given  from my dad was never returned… and over teh years other articles of clothing of mine have been altered and even damaged…. so i am just  adding  one more great dress…  that i cant afford to replace…..   to a list of damages…. all caused by a simy group of scummmmmmm

The  origional i bought because it  was quality.. because i liked how it fit me… and because  i actually worked for the  money and selected it and bought  it for me… the origional…. and real and regular person…. me-  mary jean ziska to wear…..   

seriously … who would  go to all the  trouble of  continuing to  steal… is  it a  clepto problem?  They can’t resist.. or a wanna be problem  that  they have no genuine  personality and so they  have to steal other peoples  possessions…maybe they have no taste or style of ther own? …or again i  sent  an email to scott or others and attached a picture of me in that dress….from my birthday….  so of course  they woudl have to ruin it right? . .Iis it still the idenity thief?/conartist?/actress?. who is definatley a freak…..   I can honestly say without a shadow  of a doubt… these con artists .. and thieves and criminals have done everything possible to ruin my life…. I was even thinking  that perhpas since i  took a birthday picture in my dress…. that the freak may be even trying to  lie to someoen that she is me….Ii mean what a real freak… to have  to go to that extreme  to be an imposter…. (?)  a doubleganger… a look alike…. a fake …. an imposter?????  or just a criminal who likes nice things and  has no morals or values.. and being a thief is the way they were raised…. and the way they will always be….   

God i hate criminals….. absolutely hate them…

when my mom came over the other day for lunch…. and later we went to a movie… she helped me to zip up mydress… so i called her today to see if she remembers the lining…  but i never got a complete answer to my question…..  

so when  could  my $1000.00 dollar dress have been changes/altered for a dress of lesser value?  God only knows…..  but it must have been  recently…I had only taken it out for my birthday in july… Sheesh… is this ever going to end?  If it is  not bulling… or beign lied to.. or going thorugh some horrid expereince…. then it is my personal  possessions destroyed, or stolen, or even my  safety jepordized…..  or what is next?  


I had someone   who wanted my condo   try to tell me that i shoudl move… because of all the  bad expereinces…. but it is not  my  condo.. that is  to blame… crimes are commited by individuals… they are committed with intent… and with forthought….planning,  and precision  of execution….
it is not an accident… nor a mistake… to steal…  it is a crime…..

when are these people ever  going  to be punished? caught? stopped?  or should  I ask…… are they ever going  to be punished , or stopped?

July 14Th I found out that my home was set to be auctioned off for back home owners association dues.  I have been working on solving and fixing the situation but it was auctioned on the  25Th of July.  It was sold back to the homeowners association for the amount due: $ 43,475.58

I’ve been to the bank and a loan from the  bank  using the  equity of my home would take at lest 2-3 months to process.  The mortgage on my condo was dismissed due to the fraud involved by the the  lender so there is 100 percent equity available on my home.  I am offering a $10,000.00 bonus for the opportunity  to make this loan with a 10% interest rate. I had 10 days from the sale of my home to try to get it back though a law known as the right of redemption. 

 ( florida statute: section 45.0315: right of redemption): at any time before the later of the  filing of a certificate of sale by the clerk of the court for the time specified in the judgement, order, or decree of foreclosure, the mortgagor or the holder of any subordinate interest may cure the mortagor’s indebtness and  prevent a foreclosure sale by  paying the amount moneys specified in the judgement, order, or decree of foreclosure, or if no judgement, order, or decree of foreclosure has been rendered, by tenedering the performance due under the security agreement including any amounts due because of the exercise of a right to accelerate, plus the reasonable expenses of processing to foreclosure incurred to the time tender, including reasonable attorney’s fees of the creditor. Otherwise there is no right of redemption.   



As of today I still have 4 days left otherwise the condo  title will be transferd and the condo will belong to the condo association and they can sell it for the total worth of $190.000.  I woudl like to still have the  condo in my name  which  will allow me to get the bank loan. It has been suggested that to even make you feel more comfortable with the  business proposition  I am willing to also offer a percentage of my condo until the entire loan is paid off.  If you don’t think you can do  the total amount, please consider any amount possible that would help me to reach the total amount  for the right of redemption. Please consider any amount…. everything  will be really helpful. … actually lifesaving…  and home saving in this case.. 



As you know, I am a very independent, hard working  woman and entrepreneur.   I  am responsible. I have no car payment, no credit card debt, and with the  mortgage dismissed…. no mortgage.  I plan on continuing to  work for A  Tender Loving  Care Service, and will be also getting an additonal job and a roomate to make sure that  this will never happen again! I may even go back to faux finishing as the last projects that I completed had a total project cost of approx.  $15,000.00 and I still maintained  a contract minimum or $825.00.
