So this morning my mother is going to  regions bank or Wels fargo bank to work on am equity line of credit for paying the HOA fees  at least that is what i was told… i was also i need to shut up and be quite and wait… that is  what Patrick Weber told me this entire year….  while he  was waiting for the statue of limitations to run out so that he said he would have a better  chance of altering the  cost owed to the HOA by being able to eliminate the attorneys fees and to eliminate the interest incurred since the  service of the foreclosre was done to me instead of to my guardian who bythe way is alwo a lawyer!….

Outline for support of misdealing’s with incompetent
person  who has guardian and  lawyer. Both guardian and lawyer mishandling
case.

Patrick weber is a lawyer but has not experience in defending  the suit and not able to gain access to  a pro bono lawyer who will assit in the
foreclosure suit.  Also Patrick weber is
on vacation during 30 days to submit a response to the foreclosure suit Not
working  on the case but on vacation!
Very unprofessional and unethical and not in best interest of the ward  …. Me

Not able to contact guardian  ( he is on vacation,)  I was told he has not read an of my emails
and he is not returning my phone messages.

My name is Mary Jean Ziska and I would like to file a formal
complaint against my guardian Patrick Weber. 
When  researching the Florida bar
association  their form for the official
complaint enlisted the criteria for actually suing your  attorney:

1.            The
claimant    can prove the lawyer owned
him a duty  to provide competent legal
services.

2.            The
lawyer breached his duty

3.            That the
breach caused actual damages resulting from his breach

4.            That
damages would not have occurred otherwise.

Is this the same criteria 
needed to file a complaint?   I
have had Patrick weber as my guardian since 2006 where by he  is supposed to be in charge of legal matters
and financial matters. As of this last year, he was supposed to be assisting me
in addressing a foreclosure suit by my condo HOA ( home owners
association).  The last time we met at
court he actually  took it upon himself
to tell the HOA attorney that he would waive the statute of limitations for the
foreclosure suit since  the statute of
limitations runs out  in august.   Instead of actually consulting an additional
attorney who knows anything about foreclosure defense,  (which he personally claimed he knew nothing
about) he went  against my research,
my  requests and my wishes and his
actions or non actions….( He was supposed to file for a continuance)  actually allowed the HOA to file a date of
sale with the court!  I was livid to say
the least, and  upset that this person
ordered by the Fla. Court system  to
protect my rights was instead abusing my rights and basically using his power
to make sure that my home and the protection of my home ownership would be
violated!  At  the court house, he told me to sit down and
shut up and not to interfere….  he
threatened to have me baker acted for 
standing up against his actions And telling him what he did was wrong
and would hurt my home ownership.    
After I received the paperwork with the date of sale for July 18th  I again was upset, cried and tried to reach
him.  I was told he has 150 cases to work
on , that he has never read any of my emails, and  he not only doesn’t  keep me notified of any court dates or  anything that is happening to my life and my
homeownership which is also violates  my
rights as his ward.   Without being
notified of any  additional court
hearings, or any return emails or phone calls to rectify yet another messed up
situation he created…. I received paperwork that stated he  has taken service on the foreclosure of
my  home…. He had told me  to sit and wait,  that his plan had been to not accept service
since the  law was on my side  concerning the home owners association’s
foreclosure suit  because mistakenly they
served papers to me while still having a guardian  who was supposed to be served instead of me…
Due to this  mistake on the HOA the laws
were on my side….  And since  the decision for guardianship and evaluations
still had not been completed…  He was
supposed to be asking for continuances from the court until other issues had
been rectified. 

My  condo’s mortgage
situation has also been a mess  with
multiple mortgages on my credit report and fraud from robo signers like David
stern and Ian stein who not only lost my original note but  David stern was also even sued by the state
of Florida for his fraudulent practices. 
Due to all the mishandling of my mortgage  I am under the impression that my mortgage
was dismissed.  This leaves a very nice condo
who has a value of aprox. $350,000 that many people are interest in
gaining  ownership to at a very low
price.      I cannot prove that he will
benefit financially form such an underhanded deal but what I can prove is that
he went against my request, my research, and my best interest and I may lose my
home,.  I 
have been threated continually 
that I need to  shut up  and 
that I need to allow people to steal my home…. When  this was not what should have happened…. I
have been threatened that I will be baker acted if I intercede   on my own behalf or if I contact anyone and
tell them what is going on.  I have been
told  that I only have Patrick Weber to
help me as no one else wants to or will help me… but his help is now hurting me
and my home ownership.  

What else do you need to know?  His actions are hurting me and my home
ownership and my life,  when  if he had actually read the Florida statutes,(
744) if he had asked for competent counsel 
to assist him in making g any statements in court, if he had even read
any information on the statutes of the mortgage companies and the fraud… or
even the effects of his actions on my behalf .,,, I wouldn’t be in this
situation Please Help! (I have been through ten years of hell where my life has
been  destroyed … from identity theft, to
actual theft, to bulling and and eventual nervous breakdown,  and now my home basically being stolen
for  what is owed the HOA…. A mere 20-40
thousand dollars…. HELP!

stopping criminals who have destroyed my life.

under a family by the name of Russo and as of a few months ago, I saw one of
their son’s named Mike Russo who said he hadn’t been in Florida  or at his parents condo in a while because he
had been in jail for the past four years! 
I do not know when and how the identity theft started, I do not even
know all the individuals involved but these are the people I can tell you
including  the incidents I can tell
you  that involved conartists, scams and
the stealing of identities, businesses, 
personal possessions!  These
incidents have ruined my credit, my businesses, and my life! It is still
continuing, as my condo is the next “mark”!    

       I had my
identity stolen in  2002, as per the
information on my credit report  denoted
additional credit cards and phone accounts that I never set up or used.  This may have started with the Russo sons as
one of them is now dead and another  was
in jail, but I  met a man named Gerard
Ahler  who claimed his family was part of
the mafia.  He came from Brooklyn New
York and had a business Pro-line contracting working in Marco Island.   He was working for Christine and Steve
Martucci on their home in Marco Island in 2003 and I met them through my faux
painting business M&M Decorative Painting.  
He was amazed at the money I was making and asked many questions about
my family, family money, family property, and family businesses… he also asked
about my person income, my credit, and too many personal bits of information
that I should not have answered but was too naive to know the information
necessary for identity theft,  or to harm
the other areas of my life. 

After meeting him   I
was told by his sister( Christine martucci ) 
that is was unsafe to leave my bank book and check book on my dining
room table  even though I had locked my
condo when I left for work.  I believe
this was the first time my home  and
personal information was  compromised and
my home was broken into.  Since that time
period I have had to add an alarm system, multiple locks, camera system  and use any additional types of
protection  for my home needed to try to
protect my  personal property, and for
protecting my identity.   My life has
never been the same! 

To date this group has been involved in spoofing various
cell numbers and accessing my messages. 
By accessing these messages they have stolen jobs, and been  aware of my location which allowed them
to  break and enter into my home or car
depending on my whereabouts and the length of time they knew I would be way
from my home.   They have been able to
hack into email addresses, and retrieve business and personal messages. I have
had material taken from my mail 
box,  which is a federal
offense.  Multiple laws and offenses have
occurred ultimately  harming my identity,
my credit, my ability to access the proper authorities, and ultimately in
stopping them from harming my life any further!  

I started a website to outline the multiple infractions and
I can not ever seem to catch up on all the details or the new schemes that seem
to destroy yet another area of my life. 
Is it possible to do investigations and stop these people or group of
people who seem to continue to violate my rights, the laws of this country and
continue to victimize me?

installation that was supposed to be  on march 14th 2012… i found outthat i had to be somewhere on the 14th( which of course got changed …and rearranged  but    when emailing dustin redd…  who was located in jacksonbville flroida…. who awas so nice and helpful and very professional… i thought  everything was gogin to be fine ….. there were two options for appointments.. the 10th and the 14th…. after settign up the apt for teh 14th…. everything  go t changed so i  was only able to  have an availablitity onthe 10th…. again not from  my  home  phone and cable… i received a confirmatin from  as woman whotold me no problem … she was locted in west virgina and so onteh day before i did receive an automated phone confirmation and thought allwas well… nope…..  not at all…. 

onteh morngof the 10th…. it was of course a saturday… i work up earlyu and started movign everything out of the area where i needed an additoanl cable outlet…. so far not one of the  cable guys who have come out ahce been able to  put ina  cable outlet…. or do anything  related to the calbe.. or the security system…. very suprising… well mabe not… 
So as I was saying before, I was at that for 5:00 AM but had everything well underway and in order for the 8 AM appointment at 8 AM no one showed no call at 730 or 745 when people told me they would call an hour or half an hour beforehand to let me know they were on their way. At 930 I called Comcast to find out where is the tech people were cannot reach anyone call back at 945 or 9:35 AM was able to reach Cindy who told me they were on their way at 1010 wins still known it showed up I called back and spoke with:                           who then told me the company by the name of that TS was supposed to be on their way from Sarasota and would show up at 1:00 PM at that point in time I went left my house locked up my house left my house and went to the front guard gate to try to call and see if there is any discrepancy in the phone conversation I was having with varying competent people who were supposed to be representing Comcast received I spoke with one person who then transferred me to another person who then transferred me to another person who then let me speak with one gentleman who told me that if a gentleman by the name of Mike who told me that if no one showed up by one by 2:00 PM to please give them a call back.

To me this is totally an acceptable and not typical of any type of professional company especially one of Comcast who exemplifies service and mentions their desire for excellence in service on their television commercials in their website and throughout all of their information brochures etc. By the end of all the telephone conversations I was in tears my complete date been ruined them once again someone was able to not only manipulate control and execute whatever they desired to have changed my life such as me not having the security system in my home to prevent any more criminal activity and the loss of control of my own life of my own choices of the freedom as an American citizen to be able to pick up the phone and talk to the real representatives of the Fortune 500 company is continuously devastating, frustrating, and absolutely unacceptable.     

I’m trying to decide is it the sharing of information with the people on the phone the people in person or the people online that actually contributes to all the problems. For me it seems very lonely and isolating experience to have someone control the very choices that would allow you the security of having a home protected by security system preventing criminal activity preventing trespassers preventing anyone who has for the past 12 years use my home, my name, my identity, my car, my clothing, stolen jewelry, and without any punishment. I have tried to be private I’ve tried to call and make appointments from other areas, I have tried by myself to do it is whatever is necessary to be… Secure my home my life my identity, my existence but to no avail when it’s one person against a group of criminals there is no way out.

Today was the third attempt to have a security system installed in my home this time I went to the Comcast Naples office where they confirm the appointment but could not tell me the tech people that would be showing up I confirmed online but I made the mistake of telling one person in my home to people on the phone and the security guard at my guard gate that my intention for today was to finally have a security system installed. The misinformation of what was included what the bill should be and where and how the system is installed baffles me. These are some of the misunderstandings I’ve been told that I believe are not truth:

1.  The Comcast tech who will be installing a security system may or may not be in the Comcast uniform, Comcast vehicle, have Comcast ID, and be prepared to actually install the Comcast service.

2. That you may be billed for viewing expenses, Comcast may or may not actually install cameras in the premium package. Comcast may or may not actually honor the items in the premium package featured on the website.

3. When chatting about your password or e-mail accounts set up by Comcast that you may or may not give out tons of information this information does not seem to be encrypted or secured so that you know you’re talking to a rap and have their first name it would be much better to have an ID number a chat box reference number and encrypted way of giving your Social Security number especially if you’ve had identity theft and feel uncomfortable telling a total stranger information such as your birthdate your address or telephone number and your Social Security number which is the information needed to steal identities again.
