Fifth Amendment – Due Process Clause

The Fifth Amendment’s Due Process Clause has two aspects: procedural
and substantive. Procedural due process is concerned with the process by
which legal proceedings are conducted. It requires that all persons who
will be materially affected by a legal proceeding receive notice of its
time, place, and subject matter so that they will have an adequate
opportunity to prepare. It also requires that legal proceedings be
conducted in a fair manner by an impartial judge who will allow the
interested parties to present fully their complaints, grievances, and
defenses. The Due Process Clause governs civil, criminal, and
administrative proceedings from the pretrial stage through final appeal,
and proceedings that produce ARBITRARY or capricious results will be overturned as unconstitutional.

SUBSTANTIVE DUE PROCESS is concerned with the content of particular laws that are applied during legal proceedings. Before WORLD WAR II,
the U.S. Supreme Court relied on substantive due process to overturn
legislation that infringed on a variety of property interests, including
the right of employers to determine the wages their employees would be
paid and the number of hours they could work. Since World War II, the
Court has relied on substantive due process to protect privacy and
autonomy interests of adults, including the right to use contraception
and the right to have an ABORTION.

The line separating procedure from substance is not always clear. For
example, procedural due process guarantees criminal defendants the
right to a fair trial, and substantive due process specifies that 12
jurors must return a unanimous guilty verdict before the death penalty
can be imposed. The concepts of substantive and procedural due process
trace back to English law. The MAGNA CHARTA
provided, “No free man shall be seized, or imprisoned, or disseised, or
outlawed, or exiled, or injured in any way … except by the lawful
judgment of his peers, or by the law of the land” (art. 39). According
to eminent English jurist SIR EDWARD COKE, law of the land and due process of law were interchangeable terms that possessed both procedural and substantive meaning.

The American colonists followed the English tradition of attributing
substantive and procedural qualities to the concepts of due process and
the law of the land. Maryland and Massachusetts, for example, equated
the two concepts with colonial COMMON LAW
and legislation regardless of their procedural content. On the other
hand, Virginia, Pennsylvania, and Vermont all passed constitutional
provisions identifying the law of the land with specific
procedural safeguards, including the right against self-incrimination.
Thus, when the Due Process Clause was submitted to the state conventions
for ratification, it was popularly understood to place procedural
requirements on legal proceedings as well as substantive limitations on
the law applied in those proceedings.

what is the effect of substantive or procedural due process on breach of K or 3rd party interference with K obligations?

I am a college senior studying criminal justice. I am learning
the difference between substantive and procedural due process in leiu of
the 5th and 6th amendment. This was the best explanation of
‘substantive’ due process I could find. I have searched now for 2 hours
on the internet. This one is the best example.

Thanks. I needed to know whether questions of the
constitutionality of a statute is considered “substantive” law as oppose
to procedural law.”

 So that movie was on last night again… the one  with a the karne
kahel  look alike… thought she was  British  heavier she has the same
face oh and with red hair instead of blond hair… … same face as the 
little girl  who stole my khaki  cashmere sweater… 

It was called  the bad mother’s handbook.… the actress  who actually played a woman named karen was:  Catherine Tate 

i
copied and pasted the info… if your interested… I  almost laugh at
the irony….  life imitating art.. or art imitating life… i couldn’t
watch  most of the  movie…especially when she played this horrid and
mean person…who  verbally abused and belittled her daughter…. her
own daughter…  uck… since it was on tv. I’m assuming that somehow
she had this transformation and probably became this caring and
thoughtful person.. .. but  then not all televisions shows are anything
like real life… right?
 
I wanted to post this since the picture i took when karen kahel was trespassing into my complex and running in my complex when she  had no friends or at least permission to be  coming into the complex.  The picture the police suggested i take to prove she was even in my complex and trespassing…  wasn’t that clear as to what her face looked like.. but in this movie. you can clearly see the actress… and what she( the actress )  looks like…  so since hair color  can change.. and even weight  can fluctuate….. the face will not change… and can be recognized a bit

 Like  when i was being bullied by karen kahel.. she had white blond hair…  and  and was probably  in the weight range of 110-120…   but i will never forget her face… and hope this movie will help to identify her…and to assist in drawing attention so that if there are others who’s lives she has ruined with her bulling and lies.. will be able to come forward and will be able to also press charges for the crimes she has committed…. will not be afraid to come forward…. and will  be able to stop her so that she will not  be able to harm anyone else ever again in  her life time…  and maybe if bullies run in families.. stopping her will stop  her children from harming others.. and stop the continued abuse she was able to get away with here in Naples Florida and possibly else where  during her life… maybe she was even a bully in oho state… I am sure there  are other victims… and people she has used and abused for her own selfish intentions…

The Bad Mother’s Handbook depicts the story of one year in the lives
of three women. In this television adaptation of Kate Long’s best
selling novel, Catherine Tate plays Karen, who is a frustrated woman in
her thirties whose whole life and identity are shattered when she
discovers a long-kept secret. Holly Grainger plays Karen’s clever and
hormonal teenage daughter Charlotte, while Anne Reid appears as Karen’s
mother, Nan, who is suffering from Alzheimer’s. Robert Pattinson is also
a supporting character as lovable yet nerdy, Daniel Gale. The movie
presents an insight into the life of motherhood and childhood, dwelling
on the themes that no two mothers are alike, but that ultimately love is
the most important thing of all.

 so i mentioned that yesterday i was  organizing after babysitting at a hotel last week…  but what i forgot to mention was that even before that i was opening  up a window.. in my den and realized that one chord was missing form one of my monitors in my den… this happened once before but it was the power chord to the monitor that disappeared.. i was able to use a chord from one of my mom’s old monitors but she had an entirely different system.. mine is a dell system that i purchased in 2003… this chord is a chord that  is royal blue… and attaches from the monitor into the docking station…  since i just noticed it missing.. i cant even begin to pin point when it was stolen….   does this mean i have to start locking my den with a pad lock as well???   and cant keep anything of value  on a desk?  what a bunch of thieving slime…  ( of course i could call them a lot worse…

What are the chances that I  will be able to buy a discontinued chord?? when i was checking on a new laptop… verses having a lap top fixed when it again broke…

 the guys from staples said that the docking station wouldn’t work for a new lap top…and  many  products and items have changed since 2003… and so they should..

but the items i take care of and possess.. they should remain intact… not stolen…

 my life  and my home is not some “store” or open for  thieves…. where sick psycho people think they can replace items these  degenerates or scum of the earth happen to  break… or lose or ruin….   so they ever have to pay for the consequences of all the lying  and cheating and stealing they do???????? 

a chord from a monitor… really???  gosh what petty thieves…and scum…. hope god or the police or someone will be able to stop them… and have them pay restitution for all the damage they do… 

and more than likely i am not the only  person or home they steal from ….. since these are a group of organized and disgusting criminals.. who go into homes on purpose…  with the  intent to steal….   and steal items that wont be noticed right away… i guess so they can get a way with it… and so that any evidence will not be available…. or what other reason??? 

i just want them caught and put n jail…  so i can relax and not have to wonder what cime they will commit next.. or how will they hurt my life next.. or even checking  my home or my possessions to see if they have stolen.. or ruined anything … 

god i wish I had never met that fat disgusting pig… and all his criminal scummy f associates who somehow think that stealing  is alright… but then they were probably not raised with any values… or morals.. or definitely no ethics… .. Uck!!!
